These Terms apply to all products and services offered by Aquatic Farms, LLC, including livestock, plants, dry goods, equipment, digital materials, subscriptions, consultations, preorders, special orders, and any future offerings unless separate written terms apply.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our services or place orders. By using our services, you represent that:

  • you have legal capacity to enter into a binding agreement
  • all information you provide is accurate and current
  • your use of our services does not violate any law or regulation

If you use our services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

We may update or modify these Terms at any time, in our sole discretion. Changes become effective when posted unless otherwise stated. Your continued use of our website or services after updated Terms are posted constitutes your acceptance of the revised Terms.

Your use of our website and services is also subject to our Privacy Policy. If there is any conflict between these Terms and our Privacy Policy with respect to privacy-related matters, the Privacy Policy controls for those matters.

6. Accounts

You may be required to create an account to access certain features. You are responsible for:

  • restricting access to your account
  • all activity occurring under your account
  • keeping your account information accurate and up to date

We reserve the right to suspend, restrict, or terminate accounts at any time for any reason, including suspected fraud, abuse, inaccurate information, policy violations, or behavior we believe may harm Aquatic Farms, other customers, or third parties.

7. Acceptable Use

You agree not to use our website or services to:

  • interfere with or disrupt our systems or website operations
  • scrape, crawl, harvest, or extract data without written permission

8. Product and Service Information

We attempt to describe products and services as accurately as possible. However, we do not warrant that descriptions, images, videos, listings, pricing, availability, specifications, care information, compatibility information, or other content is complete, current, error-free, or suitable for your specific situation.

Because of natural variation, especially with live animals, corals, plants, aquatics livestock, and biological products, actual items may vary from photos, videos, descriptions, sizes, colors, patterns, growth forms, and expectations.

All dimensions, weights, ages, grades, and similar information are approximate unless explicitly stated otherwise.

9. Livestock, Plant, and Biological Product Terms

Aquatic Farms may sell live animals, corals, plants, invertebrates, aquaculture products, and other living or perishable goods. By purchasing such items, you acknowledge and agree that:

  • live goods are inherently variable and may behave, grow, color up, feed, adapt, or decline differently depending on conditions beyond our control
  • you are solely responsible for ensuring that your system, habitat, water quality, environment, equipment, feeding, acclimation, quarantine, and husbandry practices are appropriate
  • compatibility between livestock, plants, habitats, and existing systems is your responsibility
  • losses can occur due to shipping stress, acclimation issues, water chemistry, aggression, disease, parasites, handling, or other causes outside our control
  • any care sheets, recommendations, verbal guidance, website content, or communications we provide are general in nature and not a guarantee of outcome

You assume all risk associated with ownership, care, acclimation, handling, treatment, and use of any live or biological products purchased from us.

10. Customer Responsibility for Legal Compliance

You are responsible for determining whether it is legal to purchase, possess, import, export, receive, transport, breed, resell, or use any item in your jurisdiction. We may refuse or cancel orders where we believe shipment, possession, or sale may violate applicable law, carrier rules, or our internal policies.

We are not responsible for confiscations, delays, restrictions, permit issues, or legal consequences arising from your location, intended use, or local laws.

11. Veterinary, Medical, and Husbandry Disclaimer

Information provided by Aquatic Farms is for general informational purposes only. It is not veterinary, medical, legal, tax, or other professional advice. You should consult a qualified veterinarian, aquatic professional, licensed professional, or other appropriate expert where necessary.

Any references to treatments, medications, preventative care, quarantine, water parameters, feeding protocols, or husbandry methods are offered without warranty and may not be appropriate in all circumstances.

12. Pricing and Availability

Prices, promotions, discounts, shipping charges, service fees, product availability, and specifications may change at any time without notice. We reserve the right to:

  • correct pricing, description, inventory, or typographical errors
  • limit quantities
  • discontinue products or services
  • substitute equivalent packaging or materials where appropriate
  • cancel or refuse any order at our sole discretion

An order confirmation does not necessarily mean acceptance of your order. We may cancel any order for any reason, including pricing errors, stock issues, fraud concerns, shipping restrictions, suspected resale abuse, or product availability problems.

If we cancel an order after payment is submitted, we will issue a refund of the amount paid, subject to any lawful deductions if applicable.

13. Payment Terms

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us to charge the full amount due, including product price, taxes, shipping, fees, surcharges, adjustments, and any other disclosed charges.

We reserve the right to:

  • verify payment information
  • refuse transactions
  • require alternate payment methods
  • delay shipment pending fraud review
  • cancel orders suspected of fraud or abuse

You are responsible for any taxes, duties, customs charges, bank fees, chargeback fees, or similar costs associated with your purchase unless otherwise stated.

14. Shipping, Delivery, and Risk of Loss

Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated in writing. Delays may occur due to weather, carrier issues, operational issues, holidays, supply interruptions, compliance checks, or other circumstances.

Unless otherwise required by law or expressly stated in writing:

  • risk of loss passes to you when the order is transferred to the carrier or made available for pickup
  • you are responsible for providing a correct shipping address and ensuring someone is available to receive time-sensitive or live deliveries
  • delays caused by incorrect addresses, missed deliveries, refusal, forwarding requests, carrier holds, weather, or local conditions are your responsibility

For live or perishable goods, you are responsible for following any delivery instructions and opening, inspecting, acclimating, and addressing any issues promptly in accordance with any posted policies.

15. Returns, Refunds, Credits, and Cancellations

All returns, refunds, replacements, credits, guarantees, live arrival policies, cancellation policies, and store credits are subject to our posted policies, any product-specific terms, and our sole review where discretion is permitted.

Unless otherwise required by law:

  • live animals, corals, plants, perishable products, custom items, special orders, and used/opened items may be non-returnable
  • cancellations may be denied or subject to fees once processing, packing, reservation, procurement, or shipment preparation has begun
  • refunds may be issued to the original payment method, as store credit, or by other reasonable method at our discretion where permitted
  • we may require photos, video, timestamps, packaging evidence, water parameter information, or other documentation to evaluate a claim

Abuse of refund, replacement, live arrival, chargeback, or customer service processes may result in denial of claims, cancellation of future orders, or termination of service.

16. Subscription, Membership, and Recurring Charges

If we offer subscription, membership, autoship, installment, or recurring billing services, you authorize recurring charges according to the terms presented at enrollment. Unless otherwise stated:

  • subscriptions automatically renew until canceled
  • you must cancel before the renewal cutoff to avoid the next charge
  • fees may change with notice
  • promotional pricing may convert to standard pricing after the promotional period

We may suspend or terminate subscription services at any time.

17. Preorders and Special Orders

Preorders, reservations, waitlists, deposits, and special orders are subject to product availability, vendor supply, import timing, weather, compliance restrictions, and operational variables. Estimated dates are not guarantees.

Deposits or prepayments for special orders may be nonrefundable unless otherwise required by law or agreed in writing.

18. Pickup Orders and In-Store Services

If local pickup, in-store pickup, or on-site services are offered:

  • you must pick up within the stated timeframe
  • valid identification or order confirmation may be required
  • we may refuse release if fraud, safety, or order integrity concerns exist
  • live and perishable items not picked up on time may be forfeited without refund where permitted by law and applicable policy

19. Promotions, Coupons, and Gift Cards

Promotions, coupons, reward credits, referral credits, gift cards, giveaways, contests, and similar programs are subject to separate rules if posted. Unless otherwise stated:

  • they have no cash value
  • they may be limited, revoked, or modified at any time
  • they may not be combined with other offers
  • they may be void if obtained through abuse, fraud, or technical error

We reserve the right to cancel promotions and correct errors at any time.

20. Intellectual Property

All content on our website and in our services, including but not limited to text, graphics, images, logos, product names, videos, audio, design, software, code, compilations, and branding, is owned by or licensed to Aquatic Farms and is protected by intellectual property laws.

Except as expressly permitted in writing, you may not:

  • copy, reproduce, modify, publish, distribute, display, transmit, sell, license, or exploit our content
  • use our trademarks, trade dress, names, logos, or branding
  • create derivative works from our website or materials
  • frame or mirror any part of our website
  • use our content for AI training, automated extraction, or commercial republication

All rights not expressly granted are reserved.

21. User Content

If you submit reviews, comments, messages, testimonials, photos, videos, suggestions, ideas, or other content to us (“User Content”), you grant Aquatic Farms a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, adapt, and otherwise exploit that User Content in any media for lawful business purposes.

You represent that:

  • you own or control the rights to the User Content
  • your User Content is accurate
  • your User Content does not violate law or third-party rights
  • your User Content is not defamatory, obscene, fraudulent, abusive, or misleading

We are not obligated to keep User Content confidential, pay compensation for it, or use it at all.

22. Communications and Consent

By using our services or providing contact information, you consent to receive communications from us, including by email, phone, text message, and automated or prerecorded systems where permitted by law and where you have provided the relevant consent.

These communications may include:

  • transactional messages
  • order updates
  • support communications
  • policy notices
  • marketing messages, if applicable and permitted

You are responsible for any carrier charges related to texts or calls. Consent to marketing communications is not a condition of purchase. You may opt out where applicable, but we may still send non-marketing transactional or legal notices.

23. Third-Party Services and Links

Our website or services may reference, integrate with, or link to third-party websites, platforms, payment processors, shipping carriers, social media services, software providers, marketplaces, or tools. We do not control and are not responsible for:

  • third-party content
  • policies or practices
  • availability or performance

24. Website Availability and Technical Disclaimer

We are not responsible for outages, hacks, data loss, incompatibility, bugs, viruses, service interruptions, or failures caused by networks, hosting, software, platforms, force majeure events, or other circumstances beyond our control.

To the fullest extent permitted by law, Aquatic Farms disclaims all warranties, express or implied, including without limitation:

  • merchantability
  • fitness for a particular purpose
  • title
  • non-infringement
  • accuracy
  • reliability
  • availability
  • compatibility
  • performance
  • course of dealing or usage of trade

We do not warrant that products, livestock, plants, services, advice, or website content will meet your expectations or produce any particular outcome.

26. Limitation of Liability

To the fullest extent permitted by law, Aquatic Farms, LLC and its owners, officers, members, managers, employees, contractors, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, business, goodwill, data, livestock, crops, animals, opportunity, or use, arising out of or related to:

  • your use of or inability to use our website or services
  • any purchase or use of products or livestock
  • delays, shipping failures, or carrier mishandling
  • husbandry failures, acclimation losses, disease, parasites, aggression, or mortality
  • inaccuracies or omissions in website content
  • account access or unauthorized account use
  • third-party services or events beyond our control

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the website, services, or products shall not exceed the amount you paid to us for the specific product or service giving rise to the claim during the 30 days preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

27. Indemnification

You agree to defend, indemnify, and hold harmless Aquatic Farms, LLC and its owners, officers, members, managers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your misuse of our website or services
  • your violation of law or third-party rights
  • your ownership, handling, transport, treatment, breeding, sale, or use of products purchased from us

  • disputes between you and any third party

28. Right to Refuse Service

We reserve the right, in our sole discretion, to refuse service, cancel orders, limit quantities, restrict account access, deny warranties or claims, prohibit transactions, or terminate relationships with any customer or user at any time, with or without notice, for any lawful reason.

29. Compliance with Laws

You agree to comply with all applicable federal, state, and local laws, regulations, ordinances, permit requirements, import/export rules, animal or agricultural rules, and carrier policies in connection with your use of our services and any products purchased from us.

30. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, severe weather, natural disasters, disease outbreaks, utility failures, supply shortages, import restrictions, labor disruptions, cyberattacks, carrier disruptions, governmental actions, war, terrorism, civil unrest, epidemics, pandemics, or infrastructure failure.

31. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.

32. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, our website, our services, or any transaction with Aquatic Farms shall first be attempted to be resolved informally by contacting us at [email protected].

If informal resolution is unsuccessful, the dispute shall be brought exclusively in the state or federal courts located in Kentucky, and you consent to personal jurisdiction and venue there, unless applicable law requires otherwise.

To the fullest extent permitted by law, you agree that:

  • disputes will be handled on an individual basis only
  • you waive any right to participate in a class action, collective action, or representative proceeding
  • any claim must be brought within one year after it arises, or it is permanently barred, unless prohibited by law

33. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

34. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

35. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely, including in connection with a sale of assets, merger, acquisition, restructuring, or operation transfer.

36. Entire Agreement

These Terms, together with any policies, notices, product-specific terms, posted conditions, and any other legal notices published by Aquatic Farms, constitute the entire agreement between you and Aquatic Farms regarding the subject matter herein and supersede prior or contemporaneous communications on that subject.
